Terms of Service

By creating an account or using HiveSeller, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

HiveSeller (“the Service”) is a software-as-a-service platform that connects to your Amazon Advertising account through Amazon's official Advertising API and helps you optimize campaigns using AI-assisted recommendations. HiveSeller is independent and not affiliated with, endorsed by, or sponsored by Amazon.com, Inc. or its subsidiaries.

You must be at least 18 years old and authorized to bind the business you represent. You are responsible for keeping your password confidential and for all activity under your account. Notify us immediately at security@hiveseller.com if you suspect unauthorized access.

• HiveSeller is a paid subscription billed monthly through our payment processor (Stripe).
• We may offer a free trial. At the end of the trial, your subscription will begin and your payment method will be charged unless you cancel before trial end.
• Subscriptions auto-renew until cancelled. You can cancel at any time from your billing page; cancellation takes effect at the end of your current billing period.
• Fees paid are non-refundable except where required by law.
• We may change pricing on 30 days' notice; price changes apply from your next renewal.

You agree to:

• Provide accurate account and billing information.
• Comply with Amazon's policies and the Amazon Advertising API terms.
• Use the Service only for lawful business purposes.
• Not attempt to reverse-engineer, decompile, or extract source code from the Service.
• Not use the Service to violate any third party's rights or any applicable law.
• Not attempt to circumvent rate limits, security controls, or access surfaces you are not authorized to use.

HiveSeller surfaces recommended actions generated by AI (e.g. bid changes, negative keyword additions, budget shifts). These recommendations are advisory. Execution waits on your approval or on approval rules you have explicitly configured. You are responsible for reviewing the recommendations you approve. We do not guarantee the accuracy, completeness, or outcomes of any AI-generated recommendation.

HiveSeller (the software, brand, design, documentation, and underlying technology) is our intellectual property and is protected by copyright, trademark, and other laws. We grant you a non-exclusive, non-transferable, revocable license to use the Service in line with these Terms during your subscription. You retain ownership of your Amazon Advertising account, your ad creative, and your business data. By using HiveSeller, you grant us a license to access, process, and act on that data only as needed to provide the Service.

The Service integrates with third-party services (Amazon Advertising, Stripe, Anthropic, Resend, Sentry, Vercel). Your use of those services is subject to their own terms. We are not responsible for the availability, accuracy, or behavior of third-party services.

We work hard to keep HiveSeller available, but we do not guarantee uninterrupted access. The Service may be unavailable from time to time for maintenance, upgrades, or reasons outside our control (including Amazon API downtime). We will give reasonable notice of planned maintenance when feasible.

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee any specific advertising outcome, return on ad spend, sales lift, ranking, or revenue. Amazon advertising is inherently variable and outcomes depend on factors outside our control (competition, seasonality, listing quality, Amazon's algorithm changes, market conditions).

To the maximum extent permitted by law, HiveSeller shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim.

You agree to indemnify and hold HiveSeller harmless from any claim, loss, or damage (including reasonable attorney fees) arising from your use of the Service, your breach of these Terms, your violation of any law, or your violation of any third-party right.

You may terminate your account at any time from the billing page or by emailing support@hiveseller.com. We may suspend or terminate your account for breach of these Terms, non-payment, abuse, or violation of Amazon policies. On termination, your access to the Service ends and we delete your data according to our Privacy Policy.

We may update these Terms as the product and law evolve. When we make material changes, we will notify you by email and update the “Last updated” date. Continued use of the Service after a change constitutes acceptance of the new Terms.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction of those courts.
